LCBO Private Ordering

A few questions:

(1)Why would two bottles be missing if you forwarded a laboratory waiver?

(2) What would happen if someone ordered two or three more cases. Would they be require to cover the entire laboratory fee?

(3) Is the labelling compliant with the LCBOs criteria? If not, as I suspect, why would the LCBO be allowed to sell this product without affixing "proper" labels.

(4) What would stop Peter from bringing in this beer on consignment? Is it volume? And, if he did, would it cost more or less than the amount paid for this order?

Not to be a stick-in-the-mud, but I think you got lucky. Someone at the LCBO actually did what they said they could do. I'm sure he or she will be reprimanded.

We need to test this again. Who's in?

I am always interested in a bottle or two of interesting beers! (PS - Can I get one of those SNPAs off you guys?!?!) I can't afford whole cases of anything though since OSAP is funding much of my life right now! (Often Securing Alcohol Program? )

As for local alternatives to SNPA, I think Publican has quoted the cost for 4x6 Black Oak Pale Ale. A 24 at the brewery is a lot cheaper I think. (In the neighbourhood of $36 I think but don't quote me on that.) No idea what the Tankhouse will retail for when it gets here.

Some answers:

1. They may have tested it anyway althought they shouldn't have needed to - but they will have credited for the used bottles. So the one case would only cost 22/24 of the value, etc. It could also be breakage (in which case also they would credit accordingly).

2. The cutoff for the $135 lab fee is 5 (standard) cases. Any order of ONE product - if there is NO lab waiver - OVER 5 cases will get charged $135. Any order UNDER 5 cases - lab waiver or not, licensee or not - will NOT get charged the lab fee.

3. I am sure it's not. But that's ok for private comsumption - and usually consignment as well to an extent. The labelling guidelines and regulations are FEDERAL they are not the LCBO's own guidelines. The LCBO just follows - and makes us follow - these federal rules. FEDERAL inspectors go into LCBO stores and inspect labelling -- and the LCBO and the rep and supplier get in trouble it it's not compliant. The federal inspectors don't come into our homes - thank god - and generally don't target licensees either -- so there is some "turning a blind eye" for these orders as a result.

4. Peter and I - and every other agent in Ontario - like any other business, are in business to make a living. It isn't about making a killing or anything but just a resonable living. For "a few bucks" a case -- clearly all the time involved and paperwork etc. (just see thread above as an example), we have to be able to bring in enough to make it worthwhile for us. BUT next is the supplier themselves. There is a host of reasons why we can't always get suppliers to work with us -- performance guarantees, they want growth, they can't expand right now, no capacity, they're simply not interested in "new markets", etc.

This particular SN order was - to them - more or less just as much (or little) work for them as any other "mail order" and the like they deal with every day. Actually getting them to commit to an agent up here, to agree to do all the labelling changes, to agree to sign all the letters the LCBO makes a supplier sign agreeing to punitive fines and the like for non-satisfactory case strength or case markings, is a different thing. We are just about to likely lose our second supplier from the U.S. in a year with a LIVE ORDER from the LCBO (i.e. for the shelves) because they are growing tired of the increasingly stringent conditions on doing business here.

Okay, enough mumble junmble, I'm off for a beer (one of our newest arrivals at Smokeless yesterday -- see other post).
